EMPLOYMENT DISCRIMINATION: $340,000 Settlement Obtained in a Disability Discrimination Claim

San Francisco – Eight health care workers are about to receive $340,000 from Contra Costa County health care provider John Muir Health as part of the settlement for a discrimination claim filed by the Equal Employment Opportunity Commission (EEOC).

According to the EEOC’s charges, the job offer for these health workers, including seven nurses and one lab technician, had been withdrawn by John Muir after the independent doctors contracted by the company performed pre-employment medical check-up and restricted them to work.

Some of the health workers undergone another independent evaluation conducted by certified allergists, who confirmed that they are free from any allergies that would disqualify them from doing their jobs in hospitals.

EEOC San Francisco Regional Attorney William R. Tamayo also expressed his appreciation to John Muir’s positive action in addressing this hiring procedure issues.

John Muir also pledged to have some revisions on its guidelines to protect its applicants and workers against possible latex-related disability discrimination.
