Centenarian Strongman No Match for Minivan

World War II veteran and travelling boxer Joe Rollino who once claimed to be “The Strongest Man in the World” died at the age of 104 years old in a car crash in New York.

The strapping and fit senior who is still known to bend quarters with his fingers, was allegedly crossing Bay Ridge Parkway in Brooklyn when he was hit by a minivan.

The centenarian suffered from serious head injuries from the impact and also broke his pelvis and his ribs. He died later on in the hospital.

The police did not arrest the driver of the minivan as there was no evidence of driving under the influence of alcohol and was well within the speed limit of the area. The driver was however, issued a summon for a defective horn.

Pedestrian accident fatalities account for as much as 11 percent of all motor vehicle crash deaths each year. In 2007 alone, 4,654 pedestrians were killed and 70,000 were injured.

Generally, there are two parties who may be held liable for a pedestrian accident: the driver of the vehicle who hit the pedestrian and the pedestrian himself who may have been careless or inattentive to traffic safety.

While a pedestrian has the duty to himself to keep himself safe by observing rules such as observing traffic signals, following crosswalks, and looking both ways before crossing the street, there are several instances when the liability of a pedestrian injury or death may fall squarely on the shoulder of the motorist.

Usually, a driver will be deemed liable in a pedestrian accident under the following circumstances:

  • Driving under the influence of drugs or alcohol
  • Failure to yield the right of way to pedestrians at marked cross walks
  • Distracted driving (texting while driving, putting on make-up, etc.)
  • Driving beyond the reasonable speed or posted speed limit
  • Non-observance of traffic signals and posts
