PEDESTRIAN ACCIDENT: Charged Party in Adrianna- Marcus hit and run case enter No contest plea

March 11, 2010

Los Angeles - Charged couple, Claudia Cabrera and Josue Luna, has pled no contest for the hit and run arraignment on Thursday. The husband and wife did not contest the charges and the Supreme Court will proceed with the selection of jury.

While the traffic signal was on red light, Cabrera persisted on driving; and hit Adrianna Bachan dead. Cabrera subsequently hit Marcus Garfinkle and injured him with serious bone fracture.

Bachan, 18 years old from Santa Barbara, was a student at University of Southern California while Garfinkle, 19 years old from Scottsdale, Arizona.

District attorneys remarked that Cabrera only stopped for his husband, Luna to remove Garfinkle from the windshield and into the lane. The couple opts for a bargain in shortening their sentence.

The case will reach immediate verdict on May 24. If found guilty, Cabrera could be sentenced to eight years of imprisonment, while Luna, seven years.

The pair was with their baby, and was heading home. Police investigation showed that Cabrera's license was on hold, and that she has failed to settle her traffic tickets.

Carmen Bachan, the mother of Adrianna, appeared on national television asking for justice on the plight of her daughter. She asked authorities to search and capture the driver of the car.

Police officials were able to arrest Cabrera few weeks after, with the aid of a $235,000 reward. Police caught Cabrera while struggling to deviate from US-Mexico itinerary.
