PERSONAL INJURY LAW: Court Finds Surgeon Guilty of Medical Malpractice

March 30, 2010

Los Angeles - A federal court has found that a certified surgeon committed medical malpractice after cutting and clipping his patient’s bile duct which he thought as a cyst.

In a court ruling, Dr. Morad Akhondzadeh has committed a “botched surgery” to his patient Juana Magnaye at the California Hospital Medical Center in Los Angeles in April 2007.

According to the complaint filed by Magnaye, she has returned to the hospital few days after her gallbladder operation due to severe pain.

The victim said Akhondzadeh performed a scan and found that the pain was caused by an obstruction in the bile duct caused by the clips her doctor had placed.

After realizing that he committed a mistake, the doctor drove Magnaye in his own car and dropped her off in front of the emergency room at the USC University Hospital.

Meanwhile, Magnaye’s lawyer Jeffrey Wolf said the doctor has “obviously committed a medical malpractice and tried to hide this by not giving his patient’s medical records and scan result to the USC Hospital.” Wolf also said the doctor wrote a note to the hospital telling that his patient “was already feeling better.” The jury has ordered Akhondzadeh to pay Magnaye with $395,000 damages.
