Hit and Run Charges Against Tyrese Gibson Dismissed

One of the cardinal rules after a motor vehicle accident is to never leave the scene of the accident unless permitted to by the authorities.

Actor and model Tyrese Gibson was recently cleared of felony citations for leaving the scene of an accident last January 10, 2010. Gibson was previously involved in a vehicular collision in Miami, Florida with Sheena McCreary.

Both parties stayed until the cops arrived for the routine investigation and the usual exchange of insurance information. Gibson and McCreary later on left the scene of the accident in a taxi together.

The prosecutors dismissed the charges against the actor after pictures were presented of the star which showed him at the scene with the police.

Suffice to say, car accidents are no simple matter – in fact, every action you make after a car accident can affect your legal standing and liability. For example, an accident, no matter how minor, carries felony charges if you hit and run away from an accident.

There are also instances, some people would admit fault at the scene even without proper legal counsel or conclusive investigation. Their admission would in turn affect their insurance claims and often, the other party may use it as a basis to file a lawsuit for damages.

It is difficult to remain cool and calm under the circumstances of a car accident but panicking would only add further stress or lead to further problems especially if you chose to run away. Here are some important things to remember if and when you’re involved in a car crash:

  • Always stop your vehicle. If your car is in the traffic lane, you may move it if no one is injured or killed.
  • Call for emergency assistance especially if someone is hurt, dial 9-1-1 to report the accident.
  • Exchange or give your information with the other driver or to any law enforcement officer. Show your driver license, registration card, evidence of financial responsibility, and current address.
  • Also make sure that you get the above-mentioned information or details needed from the other driver. If possible, also take pictures of the accident scene and take note of the weather conditions. You can also talk to witnesses and get their details and information.
  • Submit a written report to the police of CHP after an accident – while the time period is usually within 10 days, however in cases where someone is injured or killed in the accident, the report must be made within 24 hours.

Following the above-mentioned steps will entail a lot less legal trouble on your end especially if you decide to pursue personal injury claims after the car accident.
