PREMISE LIABILITY: Knott's Berry Farm, Intamin AG at fault for 2009 roller coaster accident

Los Angeles - The state Division of Occupational Safety and Health (Cal/ OSHA) has found fault in Knott's Berry Farm (theme park operator) and Intamin AG (manufacturer) for the September 16, 2009 Xcelerator blast.

The roller coaster accident left a young boy with a cut leg, and a man with back injuries.

Intamin AG failed to state clearly safety maintenance procedure and schedule for inspection. However, Cal/OSHA discovered that Knott's Berry Farm was 19 days late for its six-month routine inspection prior to the accident.

A cable broke and debris burst while transporting riders to an 80 mph 205 ft. hydraulic launch. The two severely injured riders encountered difficulty in freeing themselves from the blaze.

Cal/OSHA required Knott's Berry Farm and Intamin AG to implement modifications and safety procedures at the Buena theme park after the accident.

On Monday, the owner and manufacturer has declared its compliance with the state's requirements and resumed the operations of the Xcelerator ride.
