EMPLOYMENT LAW: L.A. Unified Teacher Terminated after 7-Year Litigation

January 27, 2010

Los Angeles- A teacher has been fired by the Los Angeles Unified School District after a 7-year court battle for an alleged misconduct.

Reports stated that Mathew Kim, a former special education instructor who is suffering from a cerebral palsy, was fired from Grant High School in Van Nuys in 2002 due to accusations that he made improper comments to students and touched the breasts of a co-employee.

The L.A. Board of Education decided to terminate Kim the following year. However, the decision was appealed to a state commission, which then overturned it.

Kim and district officials have been in constant court battle ever since. Kim was finally fired after the state commission was required by a L.A. County Superior Court judge to reverse its decision and permit the district to terminate him.

The teacher has a pending appeal.
