Mesriani Law Group Secures Summary Judgment for Business Client in Trade Secret Violation Claim

Los Angeles – The business and corporate law division of the Mesriani Law Group has successfully defended a business client against a trade secret violation claim following the granting of the Motion for Summary Judgment by the state Superior Court, resulting in $ 200,000 sanctions in favor of Czar Jewelry Inc., as well as costs in the approximate sum of $15,000 for a total of $215,000.

The summary judgment was granted after the Court had determined that there was no “triable issue of material law or facts” and found that the plaintiff had “acted in bad faith” pursuant to the bad faith standards under California Civil Code section 3426.4. A subsequent motion was brought by Mesriani & Associates seeking sanctions for their attorney’s fees and costs in defending a frivolous and worthless lawsuit.

Winning this motion is considered a major achievement for the firm since in most cases, a summary judgment is granted only in exceptional circumstances. To do this, Mesriani’s business litigation team had to overcome several obstacles, including having to deal with the legal standard that allows a party to oppose the Motion not by proving its case but by simply providing any possible dispute of law or fact.
