Mesriani Law Group Successfully Defends Business Client by way of Summary Judgment

LOS ANGELES - Mesriani Law Group would like to congratulate its Business Litigation Division on a successful Motion for Summary Judgment on behalf of one of its business clients against a frivolous misappropriation of trade secrets claim made by a competitor. In obtaining the Summary Judgment, Mesriani Law Group was able to prove that the competitor had no triable issue of law or fact to its claim. As a result, the competitor’s lawsuit is terminated and the claim is defeated.

In winning the Motion, the Business Litigation team had to overcome several obstacles. For example, they had to overcome existing legal precedent that states that Summary Judgment is disfavored and should only be granted in the most exceptional circumstances. They also had to deal with the legal standard, which allows a party to oppose the Motion not by proving its case, but by simply providing any possible dispute of law or fact. Finally, the fact that Mesriani Law Group was attempting to secure Summary Judgment as a Defendant created an even heavier burden to prove that the Plaintiff had no right to its case.

Despite all of these disadvantages, the Business Litigation team was able to prove that the competitor had no support for their claims, many times even using the competitor’s own documents and statements against them. Their exceptional legal research and knowledge of the law allowed the Business Litigation team to overcome the legal presumptions against them and to defeat the legal arguments by the plaintiff. As a result of these efforts, the court granted Mesriani Law Group’s Motion and determined that the claim against the client was baseless and without merit.

As a result of these efforts, Mesriani Law Group has allowed its client to move on with its business without a lawsuit hanging over its head. Mesriani Law Group is also now seeking an award for reimbursement of all of the attorneys fees its client incurred, pursuant to the very statute that the competitor attempted to base its claims.
