Mesriani Law Group Successfully Negotiates Settlement for Dog Attack Victim

Los Angeles – Expert personal injury lawyers of the Mesriani Law Group have successfully negotiated for the compensation of the badly-injured victim of a dog bite incident that occurred in Hermingway court, Escondido on April 2008.

According to the victim, he was relaxing at home when a neighbor’s dog, a Pit Bull, suddenly entered his house through the garage and attacked and bit his dog, a small Terrier mix.

The victim said he tried to put a stop to the commotion and to free his dog from the attack by separating them. But the Pit Bull instead turned its attention on him and attempted to attack him.

Subsequently he was able to grab the dog by its collar and forcefully pacify it.

However, after the incident he experienced pain, and significant swelling and bruising in his right hand. He also had difficulty moving his hands and the middle, ring, and small fingers of his right hand. In short, he suffered from fractured or broken fingers.

Consequently, the victim immediately sought the assistance of personal injury lawyers from the Mesriani Law Group who wasted no time in initiating an injury claim.

Under California law, a dog owner is considered negligent if he fails to take certain measures to ensure other people’s safety from attacks or bites of his animal, more especially if the dog owner knows about his animal’s nature and propensity for aggression. This also includes the failure to have the dog under proper restraint and control.

More specifically, Section 3342 (a) of California Civil Code provides that: “The owner of any dog is liable for the damages suffered by any person who is bitten by the dog while in a public place or lawfully in a private place, including the property of the owner of the dog, regardless of the former viciousness of the dog or the owner’s knowledge of such viciousness.

A person is lawfully upon the private property of such owner within the meaning of this section when he is on such property in the performance of any duty imposed upon him by the laws of this state or by the laws or postal regulations of the United States, or when he is on such property upon the invitation, express or implied, of the owner.”

Under the strict liability theory, the dog owner is therefore responsible for any damage caused by an attack from their dog.

With the timely and effective representation of the Mesriani Law Group, the negligent owner has eventually agreed to negotiate for the settlement of the victim’s injuries in the approximate sum of $80,000.

Mesriani Law Group has again secured compensation for another client and made possible his full recovery.
