ANIMAL ATTACK INCIDENT: More than $1M in Pain and Suffering Sought by Janitor in Pit Bull Attack

April 25, 2011

Sacramento – A janitor working for a motel is seeking more than $1 million from the city on Monday for the pain and suffering after a pit bull attack that police could have prevented, reports say.

Miguel Gutierrez, 57, narrates to the jury that he was working as a janitor at Motel 6 located on College Town Drive and Howe Avenue when he was attacked by two pit bulls that sheriff’s detectives failed to secure.

The attack occurred when detectives knocked on the door of two suspected robbers causing the pit bulls to bolt outside and attack Rodriguez who was rounding the motel at the time.

Detectives were able to save Rodriguez from further injuries by shooting one of the dogs. He sustained serious injuries to his left arms and hands. Rodriguez claims that police could have prevented the attack by clearing the area before approaching the suspected armed robbers.

Aside from the $1.1 million, Rodriguez is also seeking $124,000 for the medical expenses that resulted from the attack.
