Employment Law - Topic: Employer's Rights
In this episode, legal expert Rodney Mesriani discusses the issues related to employer's rights, including employment laws and statutes that apply to it. Here, Mr. Mesriani points out that some employers break the law without even knowing it. He informed listeners that employers must have knowledge of some basic employment laws. In addition to this, he also discussed at-will employment, which is commonly practice by employers in California. However, he emphasized that although employers can terminate an employee without reason under this doctrine, he also cautioned employers against dismissing an employee based on his age, gender, or disability. He reminded employers that workers and employees are protected by law against discrimination and harassment under the Fair Employment and Housing Act (FEHA) statute. Towards the end of the episode, Mr Mesriani advised employers on how to avoid possible frivolous lawsuits. He asked employers to take preventive measures such as drafting an employee manual and have it distributed to the employees, posting required posters in common areas in the workplace, and properly documenting incidents and performance of the employees. Lastly, he reminded listeners on the importance of filing a complaint under the statute of limitation, which is one year for complaints based on FEHA law and two years for claims brought under the common law. |
