PERSONAL INJURY LAW: Proposed Law to Raise Liability Cap for Train Crash Victims

Ventura – Rep. Elton Gallegly (Simi Valley) has proposed a law that would increase the liability cap for victims of passenger rail accidents such as the 2008 Metrolink train disaster in Chatsworth, reports said.

According to the report, the solon said he would want the cap to be raised from $200 million to $275 million although he expressed doubt if the amount would be enough to cover damages.

A previous bill raising the cap to $500 million was introduced but it failed to pass legislation.

The Chatsworth train accident is one of the biggest train disasters in the US railroad history that resulted in the death of 25 people and injuries to more than 130 others. The accident occurred when a Metrolink train ran a red light and crashed into a freight train.
