Punishment and Penalties for Violations in Truck Driving

The negligence of truck operators is often blamed for catastrophic accidents that involve trucks. If proven that the truck driver is the one responsible for another party’s injuries and damage in an accident, the victim should seek a Los Angeles Truck Accident Attorney who can help in recovering damages from the liable party.

Violating the rules of the road is a form of negligence. In California, regulations for truck drivers are found under the California Vehicle Code Sections. Aside from the possible payment of damages, violations of these codes can result in punishments for the truck driver.

  • Suspension for one or three years for intoxication, leaving the scene of an accident, or running away from authorities while driving a commercial vehicle. Violations that are that result to a one-year suspension are any of the following acts:

    • driving a commercial vehicle while under the influence of alcohol or controlled substances
    • being involved and leaving the scene of an accident
    • fleeing from a police officer while driving a commercial vehicle

If the driver was carrying hazardous materials at the time the violation was made, it will result in a three-year suspension.

  • Lifetime suspension for a commercial truck operator can happen under special circumstances or if proven that he committed any of the aforementioned violations more than once. Another violation that can result to this is a felony involving the manufacturing, distributing or dispensing of controlled substance, or possession of such with the intent to manufacture, distribute, or dispense it.

  • A 60-day suspension is imposed on a commercial driver if he was convicted of a serious traffic violation and if he was also convicted for a separate violation before, or within three years.
  • A commercial truck driver will also not be allowed to operate for a period of 120 days if he was proven guilty of a serious traffic violation involving the motor vehicle, and if it occurred within three years after he was also convicted for two or more separate serious violations.

A serious traffic violation under the vehicle code can be any of the following:

  • running at a rate beyond speed limit
  • reckless driving
  • a violation of State or local law regarding safe operation of a motor vehicle, especially those that are connected to the cause of fatal vehicular accidents
