DISABILITY DISCRIMINATION: Scooter Store Allegedly Fails to Accommodate Disabled Employee, Sued for Discrimination

September 6,2011

New York- Nationwide Retailer the Scooter Store has been sued by US Equal Employment Opportunity Commission (EEOC) for disability discrimination after it allegedly failed to provide reasonable accommodation to an injured employee at a store in Farmingdale.

The suit, which the agency filed in US District Court for the Eastern District of New York, claimed that the Texas-based retailer denied an employee’s request to take a temporary leave of absence due to a knee injury that caused him to suffer from psoriatic arthritis.

EEOC claimed that the employee notified The Scooter Store about his disabling injury and also informed it regarding his plans to go on a leave in order to acquire medical treatment. He also provided medical documentation to the company in order to support his request for leave.

However, the company allegedly rejected the employee’s request and it terminated him for job abandonment.

EEOC seeks monetary damages for the terminated employee. In addition, it also wants the company to enforce policies and procedures which can help it protect employees from disability discrimination.
