Severance Package Agreement
The employers have the prerogative in offering a severance package agreement to their newly hired workers. This contract entails the employers’ guarantee that the employees will receive some benefits upon their separation from the company. A severance package also acts as a consideration given by the employers in forms of monetary or insurance benefits and bonuses. However, this settlement is included in the employment contract and any violations in the terms of this agreement can be resolved in a lawsuit.
On the other hand, the employees must comply with some of the requirements stated in the severance package agreement in order to qualify for the extra benefits. Normally, these conditions apply in determining an employee’s entitlement for separation benefits:
- The employee must have continuously served the company for at least five years.
- The employment separation should be unwillingly and should not result from being charged in criminal case.
- The employment separation was certainly not due to a valid reason as stated in the definitions of the acceptable grounds for job termination.
The employers then should hand over the said benefits if the employment contract has a stipulation on severance package and if they have set up a policy of imparting severance package agreement to all or some of the employees. However, if an employee does not fall under the aforementioned conditions, he or she may still negotiate with the employer and make a deal not to file any legal charges or claims in the future.
