Star Scientific to Appeal Patent-Infringement Lawsuit Judgment

December 23, 2009

Maryland - Star Scientific is seeking to reverse a federal court judgment that R.J. Reynolds Tobacco Co. did not infringe on the company’s patents on tobacco cutting.

Star Scientific filed a patent infringement lawsuit against RJR that alleges that the company encouraged its farmers to use Star’s invention about a new method in cutting tobaccos, which reduces certain cancer –causing toxins, without permission.

However, a jury verdict last June judged ruled that RJR did not infringe on Star Scientifics’ patents.

Star Scientific filed a notice of appeal in a federal court in Maryland to convey its intent to appeal the case to the US Court of Appeals for the Federal Circuit.

Star Scientific president and CEO Paul Perito believe that the company will ultimately win the lawsuit.

R.J. Reynolds cannot be reached for comment.
