Strategies in Resolving Corporate Disputes


Los Angeles, with its thriving business set up, is a home of several multi-corporations and huge companies. No wonder business ventures in the field of arts, entertainment, printing, food and beverage are established everywhere in this place.

As business does not only involve capital but human relations as well, miscommunications between and among business associates and partners, the government or the public at large are common. Consequently, court litigation is resorted to if disputes are not resolved amicably.

In the first place, suits are prevented if someone knowledgeable with the law would enlighten the parties in the suits by giving business options or choices early on. The presence of or consultation with a corporate law attorney is a necessity for a sound business relations.

Even President Bush is not oblivious to this reality. In his speech, he promised to launch efforts to fight corruption and fraud in the corporate world.

President Bush made the following propositions or demands:

  • Longer prison sentences for the commission of fraud

  • Creation of a federal task force to track down and bring to court those culprits

  • Congress to enact a law that will make the prison sentences twice the term in cases of wire fraud or mail fraud

These laws are often the basis of prosecution of corporate crimes

  • Law to strengthen even more cases of shredding of documents and other cases of obstruction of justice

  • Creating a task force for coordination purposes

The president, in an executive order, created a Corporate Fraud Task Force that would be responsible for managing cross-agency federal inquiries.

With these developments, rest assured that cases of corporate fraud would decrease, if not eradicated completely.

Resolving Corporate Disputes

Corporation issues and disputes such as corporate fraud put on halt the mutual development and successful relations between parties.

Imagine if all disputes no matter how simple the issues are were filed in court, chaos would spread. Certainly, time, effort and money are put to waste.

However, corporate disputes may not resort to court litigation outright. There are processes that when used will definitely iron out and reconcile differences.

At this point, it is worth discussing the so-called alternative dispute resolution.

Unlike a few years back, more issues or disputes are now resolved through negotiation, mediation, and arbitration. This development has been driven by costly litigation and added business risks that parties take.

This innovation has been encouraged by the government at all levels of the business ladder. Consequently, increasing number of corporate legal departments and law firms are setting up ADR divisions or sections.

Presently, many corporations are hopeful that, with these mechanisms of solving disputes, conflicts between companies and other business establishments, government agencies and individuals are minimized.
