Toxic Tort Lawyer

In legal jargon, tort is a civil law principle which is briefly defined as a wrongful act that causes harm and for which a court of law will provide a remedy. For example, a passerby was struck, and consequently injured by a falling carpentry tool carelessly dropped by a negligent worker may file a "tort action" (lawsuit) to recover compensation from the said negligent worker.

Now, a toxic tort is one in which the wrongful act consists of exposure to a toxic substance. This incident can take place in a myriad of ways, to wit:

  • an accidental release (e.g., a chemical spill or explosion),

  • workplace exposure (e.g., to toxic solvent fumes or asbestos),

  • harmful effects from medications or other consumer products.

The obligation to compensate for injuries arising from torts is usually satisfied by paying tort compensation, or damages, to the victim/s. Damages may be recouped for a number of losses, including:

  • medical costs,

  • lost earnings,

  • and pain and suffering (i.e. mental and emotional anguish).

By placing these costs from the victim to the tort-doer, the tort system aims to fulfill to certain policy goals, including deterrence of harmful conduct and, where relevant, the promotion of public health and safety. In order to be compensated proportionally, it is best that the services of a toxic tort lawyer be availed of.

Injuries in toxic tort cases range from being "acute" (immediate) to serious latent disease. Falling in the first category are instances of fatal poisoning and burns to the skin, among others. Under the second category are those injuries which are usually the subject-matter of court litigations, such as cancer or birth defects that may not develop until many years after the toxic exposure.

In cases involving latent diseases, dispute over causation is almost always an issue. The one initiating the legal action has the heavy burden of substantiating an allegation that the disease resulted from a particular exposure, which may have occurred years earlier, rather than from some other cause external cause. At this juncture, the aid of an able and competent toxic tort lawyer should be sought for.
