United Air Temp / Air Conditioning & Heating, Inc. Faces Racial Discrimination Charges

Alexandria, Va. – The Equal Employment Opportunity Commission (EEOC) has filed a racial discrimination suit against a Virginia-based company providing maintenance services for commercial and residential heating and air conditioning systems, the agency said Monday.

According to EEOC’s lawsuit, United Air Temp / Air Conditioning & Heating, Inc. violated the provisions of the Title VII of the Civil Rights Act of 1964 when it provided less hourly wages to its non-Caucasian employees compared to its Caucasian workers who performed the same job.

Patricia Burch, an African-American, complained that from 2001 up to 2006, she and other non-Caucasian workers received lesser wages than other employees despite their complaints to the company management.

The EEOC filed the federal suit after the company refused to enter a pre-litigation settlement. The agency seeks compensation for lost wages, emotional distress, injunctive relief and punitive damages from the company.
