WRONGFUL DEATH: Wrongful Death Claim for Man Involved in Car Chase Rejected

June 14, 2011

Los Angeles- A wrongful death lawsuit brought on behalf of a 9-year-old girl, whose father was shot and left paralyzed before dying three years later, has been rejected by the jury, reports said.

The man, then 19-year-old Omar Hurtado, was chased by the police up to an apartment near 65th street before being shot with 17 bullets, with one hitting and severing his spinal cord.

He was reportedly driving a stolen car.

The defense attorney, Denise Mills, said that officer Jose Bonilla, the one responsible for Hurtado’s spinal cord injury, fired in self-defense because the car was thrusting in reverse and was headed toward him.

At least two other officers, Rose and Diaz, also fired to protect Bonilla, Mills said.

The accident happened six years ago, with Hurtado allegedly dying three years later due to the complications arising from his paralysis.

Mills rebuked the allegations, saying that Hurtado’sdeath is related to long-term drug abuse which resulted in heart problems.
